1. Introduction & Agreement

These Terms of Service ("Terms") govern your access to and use of the WhyTheDuck website and services ("Service"). By using our Service, you agree to these Terms. If you don't agree, don't use the Service.

2. User Accounts

• You must provide a valid email address or use Google Sign-In to create an account.
• You are responsible for safeguarding your account and for all activities that occur under it.
• You must be at least 13 years old to use the Service.

3. Subscriptions and Payments

• Our Service requires a paid subscription, available on a monthly or yearly basis.
• All payments are handled by our third-party payment processor, Stripe. We do not store your credit card details.
• Subscriptions are billed in advance and are non-refundable.
• We reserve the right to change our subscription fees at any time. We will provide you with reasonable prior notice of any pricing changes.

4. User Content and Ownership

Input Content: You retain full ownership of the content you provide to the Service, including website URLs, text descriptions, and uploaded files ("Input Content").

Generated Content: You also retain full ownership of the visual assets, such as mascots, icons, and videos, generated by the Service for you ("Generated Content").

By using the Service, you grant WhyTheDuck a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your Input Content solely for the purpose of providing and improving the Service.

5. Acceptable Use Policy

You agree not to use the Service to create any material that is unlawful, defamatory, harassing, libelous, invasive of another's privacy, or infringes on any third party's intellectual property rights.

We enforce usage limits to prevent abuse. This includes a maximum of 30-60 AI generations (subject to change) per day and a total storage limit of 10GB (subject to change) per account.

We reserve the right to suspend or terminate accounts that violate these rules.

6. Termination

• You can terminate your account at any time by contacting us at help@whytheduck.com.
• We may suspend or terminate your account if you breach these Terms.

7. Disclaimers and Limitation of Liability

The Service is provided "AS IS" without warranties of any kind.

WhyTheDuck will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
